New Delhi:

In Bhima Koregaon case Supreme Court (Supreme Court) Gautam Navlakha (Gautam Navlakha) has issued notice on the bail petition. The case will be heard on 15 March. The court has issued a notice to the NIA and asked to file a reply. Navlakha has challenged the decision of the Bombay High Court. The High Court had denied default bail. In fact, the Bombay High Court rejected the bail plea of accused Gautam Navlakha in the case of the Elgar Parishad involving the Maoists, saying that he sees no reason to interfere in the logical order of the special court. The special court has already dismissed his bail plea.

The bench had said that 34 days spent by Navlakha during house arrest in 2018 cannot be counted for default bail. The Pune police arrested Navlakha on August 28, 2018, but did not take them into custody. He was under house arrest from August 28 to October 1, 2018. He is currently lodged in Taloja Jail in Navi Mumbai in the judicial custody.

Navlakha challenged the July 12, 2020 order dismissing the bail application by the special NIA court in the High Court last year. He sought default bail on the basis of spending 90 days in custody and the prosecution not filing charge sheets. Earlier, the Delhi High Court had dismissed Navlakha’s detention as illegal on October 1, 2018.
