Malls Have No Right To Collect Parking Charges: Kerala High Court

Court did not ask malls to stop collection of parking fee, but said it would be at their risk

Kochi:

The Kerala High Court on Friday said that it is prima facie of the opinion that the mall has no right to levy parking fee and asked the Kalamassery municipality whether it has issued a license to Lulu International Shopping Mall in Ernakulam for the same. Justice P.V. Kunhikrishnan said this while hearing a petition. The court, however, did not ask the mall to stop the collection of parking charges, but said it would be at their risk. It has been said in the petition that the mall is illegally charging parking fee from the customers.

The court said in its order, “As per the building rules, sufficient space is necessary for the construction of a building. The parking lot is part of the building. Permission for the construction of the building is given on the condition that there will be space for parking. Whether the owner of the building will charge a parking fee is a question. Prima facie my opinion is that it is not possible.

The court asked the civic body to file a statement about its stand on the issue and posted the matter for January 28. Petitioner and film director Polly Vadakkan had moved the high court on December 2 last year after the mall collected Rs 20 from him as parking fee.
