Promise of free facilities in elections Hearing started in the Supreme Court on the application of Ashwini Upadhyay seeking to cancel the recognition of political parties. The SC reprimanded the Election Commission and said that we do not get the affidavit, but all the news papers get it. We have read your affidavit in the news paper. After all, how did the media get before us? Vikas Singh, appearing for the petitioner, argued the Election Commission that it is possible that political parties make such promises, knowing that it will be banned or adversely commented on by the regulatory authority, which will lead to actual implementation after the election. You can better meet your position by giving more promotions and benefits in comparison. SC asked the petitioner whether all political parties give their manifesto to the Election Commission before the elections? Vikas Singh said that no, there is no such rule. On behalf of the central government, the SG said that most of the freebies are not part of the manifesto, they are said in promises during the election campaign.

The CJI said that all of them believe that this is a serious issue, those who pay tax must think that tax money should be used for development and not for giving it for free. The Supreme Court said that the question is to what extent can we go in this matter. In this matter there is Election Commission, there are political parties, there should be financial discipline. Other countries should look. In India we have seen welfare schemes of the state and the centre. Welfare schemes are run at the time of flood, drought and covid. India is also a country where there is poverty and the central government is also planning to feed the hungry etc. The SG said that distribution of free gifts cannot be the only way to do public welfare. The CJI said that free gifts and social welfare schemes are different.

Abhishek Manu Singhvi, on behalf of the Aam Aadmi Party, said that the expert committee which the court is suggesting to constitute, will not take the matter anywhere. Free Bee is being misrepresented. CJI said that if we say give this and vote this in this kind of country. How can it be solved.

Advocate Vijay Hansaria said that I have given a recommendation that who can be a part of this committee. Arvind Datar said that this committee can be given a time limit of 8 weeks for the report. The CJI said that suppose if I am contesting elections, they will say 100 things, but you cannot ask them to deposit money. Till they come to power, how will they know about the budget?

Singhvi – This court should not start the journey even through a committee. This is not a judicially manageable standard. Electoral promises such as free water, free electricity or free public transport are not “free bees” but examples of discharging the “constitutional responsibilities of the state” towards creating a more equitable society. “Socialist and welfare model of development” is to provide many facilities free of cost or at concessional rates. These schemes are “absolutely necessary” in an unequal society. You cannot say that the SC should not look into the matter at all, the CJI said. .

The central government has strongly opposed the free bee culture. SG Tushar Mehta said that now this freebie culture has been elevated to the level of art and now elections are fought on this basis only. If free gifts are considered for the welfare of the people, it will lead to a disaster. This is a dangerous level. The court should intervene and set the rules. The SG said that now this culture of freelancing has been elevated to the level of art and now elections are fought only on the ground. If free gifts are considered for the welfare of the people, it will lead to a disaster. The CJI said that this is a separate issue. The wastage of the economy and the welfare of the people, both have to be balanced, so this debate should take place. There should be someone who keeps the thoughts in view. Give us these ideas until next week.
